Stalking is an English term that indicates the implementation of a series of behaviors that become persecutory towards those who suffer them, to the point of inducing the victim to change their habits and alter their psycho-physical balance.
The decree-law no. 93 of 08/14/2013 (later converted into law) as well as the Law of July 19, 2019, no. 69 (containing "Amendments to the penal code, the code of criminal procedure, and other provisions regarding the protection of victims of domestic and gender violence") called "Red Code," have introduced significant innovations to law no. 38 of 2009.
The subject matter is of great importance and very delicate, both in terms of the discomfort and social alarm it generates, and from a regulatory standpoint and the tools available to citizens to counter this type of serious and insidious crime.
Often the victim is not aware of the risk they are running, underestimates it, or does not possess the appropriate legal-criminological orientation to act incisively and determinedly for the defense of their rights.
The experience gained has shown that, to reach a concrete solution to the problem, it is often necessary to have the assistance of professionals who are experts in the field, who guide the victim step by step towards the solution through the correct collection of evidence to be used in court.
