Unlawful Interference in Private Life (Art. 615-bis Penal Code)

Anyone who, through the use of visual or sound recording devices, unlawfully obtains information or images related to private life taking place in the locations indicated in Article 614, is punished with imprisonment from six months to four years

For Jurisprudence, the private dwelling is any place that is not public or not intended as a residence, but where a person stays to perform, even in a contingent and temporary manner, acts of their private life, such as expressions of their individual activity, aimed at the fulfillment of professional, cultural, and political life falling within the broad concept of domestic freedom.

The law punishes not only the interception but also the mere installation of devices intended for the commission of the crime.

The environmental remediation intervention

It is a delicate and complex operation, aimed at ascertaining the presence of concealed electronic devices, the so-called audio or video bugs, illicitly installed in environments where confidential and highly "sensitive" information for the company is shared.
The sweep also involves the detection of laser signals capable of capturing conversations from a distance through sophisticated equipment aimed at the building's windows and wall microphones.
The activity is normally carried out during office closures and involves the intervention of numerous operators and specialized technicians, equipped with multiple technical instruments: spectrum analyzers, non-linear junction detectors, thermal cameras, video probes, analog and digital detectors, etc.

OPERATING PROCEDURES

Using sophisticated and state-of-the-art equipment as well as highly qualified personnel, following a specific mandate from the Company's Legal Representative, the Investigative Institute proceeds to identify and certify the presence of any devices intended to illicitly capture conversations.
Environmental remediation, aimed at removing the threat, is often followed by an investigation aimed at identifying the perpetrator of the installation, in order to prosecute them in the appropriate judicial venues.
Our tools allow for the detection of audio/video bugs of all kinds, whether they have internal memory or transmit remotely, as well as laser or wall microphones.

How an audio bug works

Audio bugs can be: internal memory, radio, GSM, or wifi.

  • The bugs with internal memory are micro recorders that store audio files within them;
  • Radio bugs are devices that capture and transmit audio over a limited distance. The signal is picked up by a receiver that is often connected to a recorder;
  • The GSM bugs are capable of transmitting the audio of the conversation over an unlimited distance using the cellular network. However, they contain a SIM card, which could make it easier to identify the author of the interception;
  • The wifi bugs connect to the company wifi or a portable router. Listening and recording occur remotely through a specific app.

Professional audio bugs are often concealed in everyday objects to ensure maximum discretion in listening activities. In the case of concealment within objects where electrical current is derived, they can be connected to the same network and do not require batteries; thus, they have an unlimited usage duration.

HOW A SPY MICROPHONE WORKS

The contact microphones allow you to hear what happens beyond a wall, through a highly sensitive microphone placed against the dividing wall.
The laser microphones, aimed from a distance at a window, can "translate" into audio the vibrations of the glass in a room.

How a spy micro camera works

It combines the possibility of environmental listening with image capture.
You can use wifi micro cameras or spy cameras with a recorder.
The former allow real-time viewing and listening via wifi connection. The latter record on a digital micro recorder (DVR), saving the files on internal memory or an SD card.
